END USER LICENSE AGREEMENT

1. ACCEPTANCE OF TERMS

By accessing or using memoriesofpets.com (the "Service"), you agree to be bound by this End User License Agreement ("Agreement"). If you do not agree to these terms, do not use the Service.

2. DESCRIPTION OF SERVICE

memoriesofpets.com is a pet memorial platform that allows users to create, store, and share memories of their pets through photos, text, location data, and other media formats.

3. REGISTRATION AND ACCOUNT SECURITY

3.1. You must be at least 16 years old to use this Service.

3.2. You agree to:

  • Maintain the security of your account
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

4. USER CONTENT

4.1. Content Ownership

You agree not to upload content that:

  • Violates any person's or animal's dignity
  • Contains commercial advertising without authorization

5. ACCEPTABLE USE

  • Sharing appropriate pet-related content
  • Interacting respectfully with other users

5.2. Prohibited Activities:

  • Harassing or harming other users
  • Impersonating others
  • Attempting to gain unauthorized access

  • Manipulating or disrupting the Service
  • Sharing inappropriate content

6. PRIVACY AND DATA PROTECTION

8. TERMINATION

  • Have not used the Service for an extended period

8.2. Upon termination:

  • Your access will be revoked
  • Your content may be deleted after 30 days
  • You may download your content during this period, or have your content provided to you at our discretion.

9. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, memoriesofpets.com SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. INDEMNIFICATION

You agree to indemnify and hold harmless memoriesofpets.com from any claims resulting from your use of the Service or violation of this Agreement.

12. MODIFICATIONS

12.1. We reserve the right to modify this Agreement at any time.

12.2. Continued use after changes constitutes acceptance of modifications.

12.3. We will notify users of material changes via email or Service notification.

13. GOVERNING LAW

This Agreement is governed by the laws of British Columbia, without regard to its conflict of law provisions.

14. DISPUTE RESOLUTION

14.1. Any disputes shall be resolved through:

  • Good faith negotiation
  • Mediation if necessary
  • Binding arbitration as a last resort

14.2. Any proceedings must be brought individually, not as part of a class action.
